What are the types of bankruptcy filings available for me?
Under the U.S. Bankruptcy Code, you have three options: Chapter 7, Chapter 11 and Chapter 13. Under Chapter 7, you will discharge most debts with the exception of student loans, alimony and child support, certain income taxes and fraudulent claims. You keep your exempt property which may include your homestead, qualified retirement accounts and certain life insurance benefits, for the fresh start you are entitled to. If there are liens on your house or car, you will either continue to make payments or you may discharge the debt and give up the property.
